U.S. Senator Cindy Hyde-Smith (R-Miss.) and her colleagues have taken a stand against what they deem as unlawful FCC 'Digital Equity' rules put forth by the Biden administration. Hyde-Smith, along with Senate Commerce Committee Ranking Member Ted Cruz (R-Texas) and other lawmakers, introduced a joint resolution of disapproval to nullify the Federal Communications Commission's controversial order.

Speaking out against the FCC order, Hyde-Smith expressed her concerns, stating, "The bad side effects of the Biden administration’s habitual virtue signaling will become abundantly clear under this overbearing FCC order. There’s little chance of much good happening by expanding the power of Washington bureaucrats over every aspect of the internet."

Cruz also criticized the Biden administration's move, highlighting the lack of evidence of discrimination by broadband companies. He remarked, "Despite admitting there’s ‘little to no evidence’ of discrimination by broadband companies, the Biden administration has plowed ahead with government-mandated affirmative action and race-based pricing for broadband."

The FCC's 'Digital Equity' order grants the federal government control over various aspects of the broadband industry, subjecting companies to potential enforcement actions and liabilities under a 'disparate impact' standard. The order has faced backlash for its broad scope, which includes influencing deployment decisions, pricing, customer service, and more.

The resolution introduced by Hyde-Smith and her colleagues aims to push back against what they see as an overreach of government power and a threat to internet freedom. Supported by various organizations and lawmakers, the joint effort seeks to nullify the FCC order and prevent further government control over the internet.

Joining the cause are Senators Mike Lee, Eric Schmitt, Ted Budd, and several others, along with U.S. Representatives Earl L. “Buddy” Carter and Andrew Clyde who introduced companion legislation in the House. The resolution has garnered support from Americans for Prosperity, Americans for Tax Reform, and other advocacy groups.

In a united front, these lawmakers are challenging the FCC's 'Digital Equity' rules, emphasizing the importance of maintaining a free and open internet while preventing what they see as an overreach of government regulation.
